Ending employment fairly: notice, final dues and a clean exit

Employment terminations handled poorly are the single largest source of labour disputes in Kenya. The Employment Act 2007 sets clear obligations for both parties — knowing them protects you regardless of the circumstances.

Notice periods

For employees paid monthly, the minimum notice period is 28 days or one month, whichever is longer. This applies to both resignation and employer-initiated termination. Payment in lieu of notice is permissible.

Final dues

All outstanding salary, accrued leave, and any other contractual entitlements must be paid within the normal pay cycle following the last day of employment. Withholding final dues is a violation of the Act.
